Privacy Policy for RealBuild

BY USING OR ACCESSING THE APPLICATION AND/OR THE SERVICES, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT USE OR ACCESS THE APPLICATION.

Payments

RealBuild charges a $9.99 fee when a contractor responds to a project. All payments are processed by Apple (App Store) or Google (Google Play) as in-app purchases. We never collect, receive, or store your credit card or payment details. Refund requests must be made through Apple or Google, as we cannot issue refunds directly.

Collection and Use of Information

We may collect and use information about you in a variety of ways. Examples of the types of data we collect and use include:

Derivative Data. Like most mobile applications and application operators, we gather from users of the application information of the sort that mobile browsers, depending on their settings, may make available or that our servers automatically recognize when you access the application or the Services. That information includes your Internet Protocol (IP) address, operating system and browser type, and the locations of the applications you view right before arriving at, while navigating and immediately after leaving the application. Such information is not personally identifiable, but it still may be possible for us to determine from an IP address your Internet service provider and the geographic location of your point of connectivity, as well as other statistical usage data. We analyze such information to help us better understand how the application is being used. By identifying patterns and trends in usage, we are able to better design the application to improve your experiences, both in terms of content and ease of use. From time to time, we may also release this information in the aggregate, such as by publishing a report on trends in the usage of the application.

What We Collect. Name, email, phone number, and ZIP code; optional company name, bio, profile photo, and links. Contractors may upload work photos and compliance documents (W-9, license, insurance certificate), and compliance documents are stored privately and are not publicly viewable. Investors provide project details, photos, and a project ZIP code, which we convert into approximate coordinates so contractors can find nearby work. We do not access your device's location. We also store a notification token per device, and a record of in-app purchases (transaction ID and status only, and no payment details). You are under no obligation to provide us with Personal Information of any kind, with the caveat that your refusal to do so may prevent you from using certain features of the application or the Services.

Email Communications. We may occasionally use your name and email address to send you notifications regarding new services offered by the application that we think you may find valuable. We may also send you service-related announcements from time to time. Generally, you may opt out of such emails at the time of registration or by following the unsubscribe link in the email communications, though we reserve the right to continue to send you notices about your account.

General Use. We use the Personal Information we maintain about you, and other information we obtain from your current and past activities on the application to: (1) deliver the products and services that you have requested; (2) manage your account and provide you with customer support; (3) communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us, our affiliates or other third parties; (4) develop and display content and advertising tailored to your interests on the application and other applications; (5) resolve disputes and troubleshoot problems; (6) measure consumer interest in the Services; (7) inform you of updates; (8) customize your experience; (9) detect and protect us against error, fraud and other criminal activity; (10) enforce our Terms and Conditions; and (11) do as otherwise described to you at the time of collection. At times, we may look across multiple users to identify problems. In particular, we may examine your Personal Information to identify users using multiple user IDs or aliases. We may compare and review your Personal Information for accuracy and to detect errors and omissions.

Disclosures of Information

We may disclose your Personal Information under the following circumstances:

By Law or to Protect Rights. When we believe disclosure is appropriate, we may disclose your Personal Information: (1) in connection with efforts to investigate, prevent or take other action regarding illegal activity, suspected fraud or other wrongdoing; (2) to protect and defend our rights, property or safety or those of our users, our employees or others; (3) to comply with applicable law or cooperate with law enforcement; (4) to enforce our Terms and Conditions or other agreements or policies; (5) in response to a subpoena or similar investigative demand, court order or request for cooperation from a law enforcement or other government agency; (6) to establish or exercise our legal rights; (7) to defend against legal claims; or (8) as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

Online Postings. Certain Personal Information collected from you is disclosed as a matter of course as a result of your use of the application. We may provide publicly-viewable areas on the application where you can post reviews and other information relating to your activities on the application. Such postings are governed by our Terms and Conditions. Whenever you voluntarily disclose Personal Information in publicly-viewable areas of the application, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. In addition, such postings may appear on other mobile applications or when searches are executed on the subject of your posting. We cannot control who reads your postings or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your Personal Information. YOU ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM YOUR VOLUNTARY DISCLOSURE OF PERSONAL INFORMATION.

Sharing. We do not sell your information. Contact details are shared only when you choose to share them; an investor's contact becomes visible to a contractor after the investor releases it. We use service providers to run the app: hosting and database (Supabase), notifications (Apple, Google, Expo), and email (Resend). These service providers may have access to your Personal Information as needed to perform their functions, but are not permitted to share or use such information for any other purpose.

Affiliates. We may share some or all of your Personal Information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us. Such intercompany transfers may be to and from the United States and any other country in which we or our agents maintain facilities for the purposes identified in this Privacy Policy, as well as for storage, processing or other business use as permitted under this Privacy Policy.

Business Transfers and Bankruptcy. We reserve the right to transfer all of your Personal Information in our possession to a successor organization in the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets. You acknowledge that any such transfers may occur, and that the successor organization or other transferee may decline to honor commitments made in this Privacy Policy.

Tracking Technologies

Cookies. We use cookies on the application to: (1) keep track of the Services you have used; (2) record registration information regarding your login name and password; (3) record your user preferences; and (4) keep you logged into the application. We also use cookies to track the pages that you visit during each session, both to help us improve your experience and to help us understand how the application is being used. We analyze and disclose in aggregated form information gathered using cookies, so as to help us, our partners and others better understand how the application and the Services are being used. We do not attempt to link information gathered using cookies to your Personal Information. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the application or the Services.

Mobile Beacons. We may use mobile beacons on the application and in emails to count users who have accessed particular pages and viewed emails, and to deliver co-branded services. Mobile beacons are also a technique we may use to compile aggregated statistics about usage of the application. Mobile beacons collect only a limited set of information, including a cookie number, time and date of a page or email view and a description of the page or email on which the mobile beacon resides. You may not decline mobile beacons. However, they can be rendered ineffective by declining all cookies or by modifying your mobile browser's settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

Analytics. We do not currently use third-party analytics or tracking services. If we add analytics or tracking partners in the future (such as Google Analytics or similar services), we will update this Privacy Policy and our App Store data disclosures accordingly. Any such future services will be used only to help us understand how the application is being used and to improve your experience.

Links to Third Party Mobile Applications

The application and the Services may contain links to third party mobile applications and applications of interest, including advertisements and external services. However, once you have used these links to leave the application, you should note that we neither own nor have any control over those third party mobile applications or applications. Thus, this Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. Before visiting any third party mobile applications or using any third party applications, whether by means of a link on the application, directly through the application or otherwise, and before providing any Personal Information to any such third party, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that mobile application or application, and should take those steps necessary to, in your discretion, protect the privacy of your data.

Security

We use reasonable administrative, technical and physical measures to protect your Personal Information from loss, theft, alteration or misuse. However, please be advised that even the best security measures cannot fully eliminate all risks. Any data disclosed online is vulnerable to interception and misuse by unauthorized third parties. We cannot guarantee that only authorized persons will view your Personal Information. We are not responsible for third party circumvention of any privacy settings or security measures.

Data Retention

We retain your Personal Information for as long as your account is active or as needed to provide you with the Services. When you delete your account, we permanently remove your profile, projects, inquiries, and uploaded files. We may retain some information (such as transaction records) for up to 7 years to comply with legal, tax, and fraud-prevention obligations.

Deleting Your Account

You can permanently delete your account and data anytime in the app: Settings → Additional Settings → Delete account. This immediately removes your profile, projects, inquiries, and uploaded files. You may also email team@realbuildapp.com to request deletion. We will retain in our files some of your Personal Information to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions and comply with legal requirements as is permitted by law. Privacy Policy Changes

We reserve the right to make changes or modifications to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Version Date" of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the application, and you waive the right to receive specific notice of each such change or modification. We encourage you to regularly review this page for any changes to this Privacy Policy.

Terms and Conditions of Use for RealBuild

Terms

You agree that by using this Application and/or the Services, you have read, understood and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE APPLICATION AND THE SERVICES, AND YOU MUST DISCONTINUE USE IMMEDIATELY. By accessing this Application, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this application. The materials contained in this application are protected by applicable copyright and trademark law.

To access the Services, you must first register with the application. By registering with the application, you represent and warrant that: (1) all registration information you submit will be true, accurate, current and complete; (2) you will maintain the accuracy of such information and promptly update such registration information to keep it true, accurate, current and complete; (3) you will keep your password confidential and will be responsible for all use of your password and account; (4) you have the legal authority in your jurisdiction to enter into binding contracts and to conduct the business activities described in these Terms and Conditions; (5) you have the legal capacity and you agree to comply with these Terms and Conditions; (6) you will not access the application through automated or non-human means, whether through a robot, script or otherwise; (7) you will not use the application or the services for any illegal or unauthorized purpose; and (8) your use of the application or the services does not violate any applicable law or regulation.

RealBuild is a marketplace for business use. Real estate investors post projects, and construction professionals pay a fee to respond and connect. You are responsible for the work, contracts, and payments you arrange with other users; RealBuild is not a party to those agreements and does not guarantee any outcome.

As a registered user of the application, you agree not to:

  1. systematically retrieve data or other content from the application to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from us;
  2. make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses;
  3. circumvent, disable or otherwise interfere with security-related features of the application, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the application and/or the Content contained therein;
  4. engage in unauthorized framing of or linking to the application;
  5. trick, defraud or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords;
  6. make improper use of our support services or submit false reports of abuse or misconduct;
  7. engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots or similar data gathering and extraction tools;
  8. interfere with, disrupt or create an undue burden on the application or the networks or services connected to the application;
  9. attempt to impersonate another user or person or use the username of another user;
  10. sell or otherwise transfer your profile;
  11. use any information obtained from the application in order to harass, abuse or harm another person;
  12. use the Services as part of any effort to compete with us or to provide services as a service bureau;
  13. decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the application;
  14. attempt to bypass any measures of the application designed to prevent or restrict access to the application, or any portion of the application;
  15. harass, annoy, intimidate or threaten any of our employees or agents engaged in providing any portion of the Services to you;
  16. delete the copyright or other proprietary rights notice from any Content;
  17. copy or adapt the application's software, including but not limited to Flash, PHP, HTML, JavaScript or other code;
  18. upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the application or modifies, impairs, disrupts, alters or interferes with the use, features, functions, operation or maintenance of the Services;
  19. upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, mobile bugs, cookies or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms");
  20. except as may be the result of standard search engine or Internet browser usage, use, launch, develop or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper or offline reader that accesses the application, or using or launching any unauthorized script or other software;
  21. disparage, tarnish or otherwise harm, in our opinion, us and/or the application; and
  22. use the application in a manner inconsistent with any applicable laws or regulations.

If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the application (or any portion thereof). Supplemental terms and conditions or documents that may be posted on the application from time to time are hereby expressly incorporated herein by reference.

Use License

a. Permission is granted to download and use the RealBuild application for its intended purpose as a marketplace connecting real estate investors and construction professionals. This is a grant of a license, not a transfer of title, and under this license you may not: i. modify or copy the underlying software or code; ii. attempt to decompile or reverse engineer any software contained on this mobile application; iii. remove any copyright or other proprietary notations from the materials; or iv. transfer the license to another person or "mirror" the application on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated at any time.

Disclaimer

a. The materials on this mobile application are provided "as is". There are no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, there are no warranties or any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet mobile application or otherwise relating to such materials or on any applications linked to this application.

Limitations

In no event shall the company or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on this Internet application, even if a representative or authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Revisions and Errata

The materials appearing on this mobile application could include technical, typographical, or photographic errors. There is no warranty that any of the materials on its mobile application are accurate, complete, or current. Changes to the materials contained on its mobile application may be changed at any time without notice. However, there is no representation of any commitment to update the materials.

Links

All of the applications linked to this Internet mobile application have not been reviewed and the company is not responsible for the contents of any such linked application. The inclusion of any link does not imply endorsement by the company of the application. Use of any such linked mobile application is at the user's own risk.

Application Terms of Use Modifications

The company may revise these Terms and Conditions for its mobile application at any time without notice. By using this mobile application you are agreeing to be bound by the then current version of these Terms and Conditions.

Governing Law

Any claim relating to the company's mobile application shall be governed by the laws of the state of Pennsylvania. In the event that litigation results from or arises out of this Agreement or the performance thereof, the Parties agree to reimburse the prevailing party's reasonable attorneys' fees, court costs, and all other expenses, whether or not taxable by the court as costs, in addition to any other relief to which the prevailing party may be entitled.
